       I William Fairleigh, Clerk of the Court for the County aforesaid, do certify that the foregoing deed from Richard Stith’s Heirs by Gabe Wathen, Chas. A. Craycroft and Danl. M. Jones as commissioners to Jesse Stith was produced in open court at the court house in Brandenburg on Monday the 7th day of October 1844. And Acknowledged by said commissioners to be their act and deed for the purposes therein mentioned. Which was ordered to be entered of record. Whereupon I have truly recorded the same in my office at Brandenburg this 22nd day of November, 1844.

This Indenture made and entered into this first day of October in the year of Our Lord One Thousand Eight hundred and forty four. Between Buckner J. Stith, William Stith, Edmond Stith, Jesse Stith, Thomas H. Stith and Lucy his wife, Griffin Stith and Susan his wife, Joseph E. Hardaway and Martha his wife, Henry Stith and Mary Ann his Wife, Daniel Stith and Jane his wife, Elijah Shacklett and Mary W. his wife, Agnilla D. Reed and Sophia his wife, William Saunders, Richard Saunders, Peter S. Saunders and Benjamin C. Saunders By Gabriel Wathen, Charles A. Craycroft and Daniel M. Jones, Commissioners specially appointed by the Meade County Court in the State of Kentucky of the One part and John C. Stith of the other part. Witnesseth that whereas by virtue of an order of the Meade County Court of the state afsd. at the application of Stith the Commissioners afrsd. were directed to make deeds of partition and release to and between the parties. Now Therefore this Indenture witnesseth that the sd. parties of the first part by the Commissioners afsd. for and in Consideration of the premises afsd. and the farther Consideration of the sum of One Dollar to them in hand paid the receipt whereof is hereby acknowledged have this day and by these presents do grant, bargain, sell enfeoff alien and convey unto the said John C. Stith his heirs and assigns the following tract or parcel of land lying being in the county of Meade and State afsd. and bounded as follows (towit) Beginning at a stake or stone at a pond at figures 23 thence due W. 117 poles to two red Oaks and a post Oak. thence due N. 292 poles to a post Oak. thence N. 55 E. 26 poles to a post Oak. thence N. 68 E. 48 to two post Oaks thence due E. 32 poles to a post. Oak. thence N. 70 E. 20 poles to a red Oak and post Oak. thence due S 32 poles to the Beginning. Containing two hundred and twenty eight acres. To have and to hold the above described tract or parcel of land unto the said John C. Stith his heirs and assigns free from the claim or claims of all and every person whatever. And the said parties of the first part by the Commissioners afsd. do farther Covenant and agree to and with the sd. J. C. Stith to warrant and defend the aforesaid tract or parcel of land free from the claim or claims of all and every person claiming the same by through or under them or either of them. But in no event are the commissioners afsd. to be held accountable by reason of any stipulation or covenant contained in this deed. In testimony whereof the said parties of the first part by the commissioners afsd. have hereunto set their hands and seals of the sd. parties of the first part. The day and year above written
