This deed has to do with the settlement of the estate of Richard Stith, Jr.  It is typed from an original handwritten copy of the 1844 deed from the Richard Stith heirs to Jesse Stith.  This deed copy was in posession of Jack J. Scott until January 2001.   It is now in possession of Jess B. Scott.   The text of the deed yields data on the descendents of Richard Stith Jr.  According to Kenneth Stith, Richard Stith Jr. died 13 Apr 1843 in Stithton and his wife Elizabeth Jones Stith died 24 Aug 1844 in Stithton.  According to the will of Jesse Jones Stith, Richard Stith, Jr. and Elizabeth Jones Stith were buried on the farm where Jesse lived.  This deed would apparently describe that property.   .... This Indenture made and entered into this first day of October in the year of Our Lord One Thousand eight hundred and forty four. between Buckner J. Stith, William Stith, John C. Stith, Edmond Stith, Thomas H. Stith and Lucy his wife, Griffin Stith and Susan his wife, Joseph E. Hardaway and Martha his wife, Henry Stith and Mary Ann his Wife, Daniel Stith and Jane his wife, Elijah Shacklett and Mary W. his wife, Aquilla O. Reed and Sophia his wife, William Saunders, Richard Saunders, Peter S. Saunders and Benjamin C. Saunders.   By Gabriel Wathen, Charles A. Craycroft and Daniel M. Jones, Commissioners specially appointed by the Meade County Court in the State of Kentucky of the one part and Jesse Stith of the other part. Witnesseth that whereas by virtue of an order of the Meade County Court in the state afsd. at the application of _____ Stith the Commissioners afsd were directed to make deeds of partition and release to and between the parties. Now therefore this Indenture witnesseth that the said parties of the first part by the Commissioners afsd for and in consideration of the premises afsd and the farther consideration of the sum of one dollar to them in hand paid the receipt whereof is hereby acknowledged have this day and by these presents do grant, bargain, sell enfeof alien and convey unto the said Jesse Stith his heirs and assigns the following described tracts or parcels of land lying being in the county and state afsd the first of which is bounded as follows (to wit) Beginning at two black Jacks in Hardins line and figure one thence N15E102 poles to two black Oaks thence N46W117 poles to a stake or stone in a lane thence S20 1/2 W with the lane 67 poles to a hickory thence S70 W80 poles to a stone Thence S13 E92 poles to a white Oak thence due E 152 poles to the Beginning containing one hundred and thirty acres.  The second tract is an undivided moiety of two hundred and sixty acres and bounded as follows (to wit) Beginning at a white oak an original corner of May Bannister & Co thence due E 360 poles to a black oak thence due N 98 poles to two Red Oaks and a post Ok thence due N 428 poles to a black Jack and a Red Oak thence N 80 E 11 poles to a hickory thence N70 E60 poles to a stone thence S13 E90 poles to the Beginning.  (Said tracts of land having been allotted to the late widow of Richard Stith Deed by the Commissioners afsd by consent of all parties concerned and especially by Jesse Stith and after her death to pass to sd Jesse Stith which said widow has since departed this life.) To have and to hold the above described tracts or parcels of land unto the sd Jesse Stith his heirs and assigns free from the claim or claims of all and every person or persons whatsoever. And the said parties of the first part by the Commissioners afsd. do farther covenant and agree to and with the sd Jesse to warrant and defend the afsd tracts or parcels of land from the claim or claims of all and every person claiming the same by through or under them or either of them but in no event are the Commissioners afsd. to be held accountable by reason of any stipulation or covenant contained in this deed. In testimony whereof the said parties of the first part by the commissioners afsd have hereunto set their hands and seals the day and year above written.
